The Tribunal found that the respondent admitted both the issuance of the cheque and the outstanding debt, and that the only defense raised was financial hardship and lack of operations. The Tribunal held that as long as the cooperative society exists and has not been liquidated or declared insolvent, it remains liable for its debts under Section 22(c) of the Cooperative Societies Act. Financial challenges do not extinguish the statutory obligation to repay debts. Since the debt was not disputed, the Tribunal concluded that the claimant was entitled to the outstanding sum, costs, and interest as prayed.
