Miscellaneous Application / Ruling on Application for Stay and Review of Previous Orders

  1. 1 Whether there was an error apparent on the face of the record justifying review or variation of the order made on 25th April, 2013.
  2. 2 Whether the applicant was properly served with the hearing notice for the application dismissed on 25th April, 2013.
  3. 3 Whether a stay of execution of the award delivered on 17th April, 2012 should be granted pending determination of the application.

Ratio Decidendi

The court found that there was a mistake or error apparent on the face of the record regarding the service and hearing of the application dated 3rd April, 2013. The court noted that the applicant had presented evidence of service and that the grounds of opposition did not clearly dispute service. In the interests of justice, the court determined that the order dismissing the applicant's earlier application should be reviewed and vacated. The court also granted a stay of execution of the award delivered on 17th April, 2012 pending the hearing and determination of the application, holding that the procedural irregularity justified intervention to prevent prejudice to the applicant.
