The High Court found that although the respondent pleaded loss of user, he failed to provide any credible or tangible evidence to prove he was earning Kshs. 5,000 daily from the use of his vehicle. No business licenses, receipts, bank statements, or other documentation were produced to substantiate the claim. The court reiterated that special damages, including loss of user, must be specifically pleaded and strictly proved. The trial magistrate erred in awarding Kshs. 240,000 for loss of user in the absence of such proof. Consequently, the award for loss of user was set aside, and judgment was entered only for the proven material damage. Costs of the appeal were awarded to the appellant.
