Procedural Posture

Miscellaneous Application / Ruling on Reference Application Regarding Advocate Client Accounts and Costs

  1. 1 Whether the 1st Respondent fully accounted for and remitted all monies due to the Applicant from the settlement of PMCC Nos. 24, 25, and 26 of 2017 and related appeals.
  2. 2 Whether the 1st Respondent was properly retained and entitled to deduct legal fees as claimed.
  3. 3 Whether the Applicant is entitled to further sums or an account from the Respondents.

Ratio Decidendi

The court found that the 1st Respondent was entitled to deduct one third of the decretal sums as legal fees in each of the three referenced cases, but was required to account for and remit the balance to the Applicant. The court determined the precise amounts due to the Applicant after deducting legal fees and ordered the 1st Respondent to pay specified sums directly to the Applicant and to deposit the remaining balances in a joint fixed deposit account pending taxation of advocate-client costs by the Deputy Registrar. The court held that any further dispute on costs must be resolved through the taxation process, and that both parties should bear their own costs of the application.

Court Disposition

Application allowed in part; orders issued for remittance and accounting of settlement sums, with further costs to be determined by taxation.
