However, the respondent was entitled to set off the outstanding loan from the claimant's deposits before making any refund. The Tribunal held that any by-law or contractual provision purporting to prevent resignation while a loan is outstanding is void if the member's deposits exceed the loan amount, as this would contravene the statutory right of setoff under the Co-operative Societies Act.
