Ratio Decidendi

The court found that although the present suit and Civil Case No. 164 of 2009 involved the same parties and arose from the same contract, the issues were not entirely the same. More importantly, Civil Case No. 164 of 2009 was not heard and determined on its merits but was marked as closed by consent of the parties. As such, the essential requirement for res judicata—that the matter has been heard and finally determined by a competent court—was not satisfied. Therefore, the plea of res judicata could not succeed. The court also noted that the stay of proceedings previously issued had lapsed, as the stay was pending determination of Civil Case No. 164 of 2009, which is now closed.
