Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial court erred in awarding underpayment to the respondent despite lack of specific pleadings on underpayment.
  2. 2 Whether the applicable minimum wage for the respondent was correctly determined by the trial court.

Ratio Decidendi

The appellate court found that the respondent did not specifically plead underpayment in his memorandum of claim, and underpayment is a form of special damages that must be specifically pleaded and proved. The trial court's award of Ksh 154,969 for underpayment was therefore without legal basis, as evidence and submissions cannot substitute for proper pleadings. Consequently, the appellate court set aside the trial court's judgment awarding underpayment, except for the order requiring issuance of a certificate of service. The rest of the respondent's claim was dismissed, and each party was ordered to bear its own costs of the appeal.

Court Disposition

Appeal allowed in part; trial court's award of underpayment set aside; order for certificate of service upheld; no order as to costs.

Orders

  • The trial court's judgment/decree delivered on October 5, 2022 is set aside, save for issuance of a certificate of service.
  • The rest of the respondent's claim filed in the trial court is dismissed.
