The High Court found that the trial court failed to inform the appellant of his constitutional right to legal representation as required by Article 50(2)(g) and (h) of the Constitution of Kenya, 2010. Although the evidence established that the appellant interfered with a wetland without the necessary approvals, the procedural irregularity in failing to advise the appellant of his rights rendered the trial unfair.
