The required discharge fee was paid. The only reason the defendant withheld the titles was the pendency of a High Court case among the partners, which has since been concluded. The defendant was not a party to that dispute and had no legal basis to continue withholding the titles. The court held that the plaintiffs are entitled to have the properties discharged and the titles released to their representative. The plaintiffs proved their case on a balance of probabilities.
