The amended Defence filed by the Appellant raised triable legal issues regarding the applicability of Section 10(1) of the Insurance (Motor Vehicle Third Party Risks) Act to private vehicles not required by law to cover passenger liability. The trial magistrate erred in striking out the amended Defence, as these issues should have been canvassed at a full trial. The court found that denying the Appellant the opportunity to defend the suit was improper, and therefore allowed the appeal, set aside the ruling of the trial magistrate, and reinstated the amended Defence for determination at trial.
