The delay in filing the application was therefore justified. The court recognized the public interest in granting stay of execution, as the decretal sum would be paid from public funds. The grounds of appeal were not frivolous, and as a public institution, the applicant was exempt from providing security for costs. The court exercised its discretion to grant leave to appeal out of time and ordered a stay of execution, conditional upon the applicant filing the appeal within 60 days.
