The appellate court found that the trial court erred in awarding salary arrears to the Respondent for a period when no services were rendered, as such arrears are only justified where reinstatement is granted. The award of 12 months’ salary as damages was also set aside, as the trial court failed to consider the statutory factors for compensation and the Respondent contributed to his dismissal. The court substituted the award with 6 months’ salary for unfair dismissal. The decision to decline reinstatement was upheld, as reinstatement is discretionary, subject to statutory time limits, and not appropriate where trust is eroded or significant time has lapsed.
