The Employment and Labour Relations Court lacks jurisdiction to grant leave to appeal out of time against its own judgment to the Court of Appeal; such jurisdiction lies exclusively with the Court of Appeal under Rule 4 of the Court of Appeal Rules. However, the court retains jurisdiction to grant a temporary stay of execution of its judgment to preserve the substance of the intended appeal and to afford the applicants an opportunity to seek extension of time and further stay from the Court of Appeal.
