The Court found that although the delay in filing the notice of appeal was approximately four months, most of this period was spent pursuing stay of execution and extension of time before the superior court, which was a plausible explanation. The intended appeal was not frivolous and raised arguable grounds. The respondent, as a constitutional body, would not suffer undue prejudice as he could be compensated, and the applicants have the right to appeal. Balancing both parties' rights, the Court exercised its discretion to allow the application for extension of time, subject to the applicants filing and serving the notice of appeal within seven days and the memorandum and record of appeal...
