The High Court found that the trial magistrate failed to adequately engage with the authorities cited by the parties and did not sufficiently justify the award of Kshs. 700,000.00. Upon reviewing the injuries sustained by the Respondent, which were limited to a degloving injury of the right foot with residual pain and scarring but no disability, the court determined that the injuries were less severe than those in the cited precedents where higher awards were made. The court held that the principle of comparable awards required a downward adjustment, as the Respondent's injuries did not warrant the amount previously awarded.
