Furthermore, the appeal was filed outside the statutory thirty-day period prescribed by section 79G of the Civil Procedure Act, and there was no evidence that the appellant sought or obtained leave to file the appeal out of time. As such, the appeal was incompetent and could not be entertained. The court therefore dismissed the appeal both on the merits and on procedural grounds, and awarded costs to the respondent.
