The allocation and issuance of a letter of allotment to Joseph Njunge Mukirae, and subsequent transfer to the 1st Defendant, was therefore irregular and unlawful, as the property was not unalienated government land. The 1st Defendant's title, having been acquired through a process tainted by fraud and procedural impropriety, could not be protected under the Registration of Titles Act or the Land Registration Act.
