Procedural Posture

Contempt Application / Ruling on Notice of Motion for Contempt

  1. 1 Whether the Plaintiff/Respondent was in contempt of court orders requiring maintenance of status quo as at March 10, 2020.
  2. 2 Whether the Plaintiff/Respondent unlawfully evicted the Defendant/Applicant's son and cultivated the entire suit property in breach of court orders.

Ratio Decidendi

The court found that both the Plaintiff/Respondent and the Defendant/Applicant's son were in occupation of the suit property as at March 10, 2020, with the Plaintiff/Respondent occupying 7.5 acres and the Defendant's son occupying another portion. The Plaintiff/Respondent, by entering the property with armed men, evicting the Defendant's son, and cultivating the entire 6.2 hectares, exceeded the status quo and breached the court order. The Plaintiff/Respondent was aware of the order, had extracted it, and her actions constituted wilful disobedience. The court was satisfied that the requirements for contempt had been met and found the Plaintiff/Respondent in contempt of court.
