The evidence showed that the 2nd Respondent was registered as proprietor only because the Applicants' father died before adjudication, and that he inherited their mother according to Teso customs. The court held that this created a constructive trust in favour of the Applicants, and the 2nd Respondent's subsequent transfer of the land to the 1st Respondent amounted to unjust enrichment.
