Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Intended Appeal

  1. 1 Whether the applicant is entitled to an order of stay of execution of the judgment pending appeal.
  2. 2 Whether the notice of appeal filed by the applicant properly challenges the operative order (confirmation of grant).

Ratio Decidendi

The court found that the applicant had not filed a notice of appeal against the operative order confirming the grant, but only against a subsequent order that merely gave effect to the confirmation. Since the confirmation of grant had not been challenged, a stay of execution of the subsequent order would not prevent execution of the unchallenged confirmation. The application for stay therefore lacked a proper legal basis and was without merit. The court emphasized that the substratum of the dispute was the confirmation of grant, and without a challenge to that order, the application for stay could not succeed.
