Procedural Posture

Land and Property Suit / Judgment After Formal Proof

  1. 1 Whether the Plaintiff is the lawful proprietor of Makuyu/Makuyu/Block II/1284.
  2. 2 Whether the Defendant's occupation of the suit land is unlawful and amounts to trespass.
  3. 3 Whether the Plaintiff is entitled to eviction orders and costs.

Ratio Decidendi

The Plaintiff established, through unchallenged evidence and production of a valid title deed, that she is the absolute and indefeasible owner of the suit land. The Defendant failed to file any defence or rebut the Plaintiff's claim. The Land Registration Act confers upon the registered proprietor absolute ownership and rights to possession, occupation, and use of the land, subject only to statutory exceptions. The Defendant's entry and continued occupation of the land without the Plaintiff's consent constitutes trespass and a violation of the Plaintiff's proprietary rights. The Plaintiff is therefore entitled to eviction orders and costs as prayed.

Court Disposition

Plaintiff's claim allowed; eviction and costs awarded.

Orders

  • The Defendant, his family members, employees, agents, and any person claiming under him to vacate Makuyu/Makuyu/Block II/1284 within 60 days; in default, eviction to issue in accordance with the law.
  • Costs of the suit to be met by the Defendant.
