Procedural Posture

Land and Property Suit / Judgment

  1. 1 Whether the Defendant is entitled to the entire parcel of land Machakos/Kiandani/243 or only a portion purchased in 1977.
  2. 2 Whether the Defendant proved the existence and payment for a second land sale agreement for the remaining portion of the suit land.
  3. 3 Whether the Plaintiff is entitled to an order of eviction and injunction against the Defendant for trespass beyond the portion sold in 1977.

Ratio Decidendi

The court found that while the Defendant proved purchase and occupation of a portion of Machakos/Kiandani/243 in 1977, there was no written agreement or sufficient evidence of payment for the alleged second portion in 1983. The Plaintiff, as registered owner by transmission, was entitled to possession except for the portion sold in 1977. The Defendant's counter-claim failed for lack of proof of the second sale. The Plaintiff's suit was not time-barred as the title was registered in her name in 2013 and the suit was filed within twelve years. The court granted an injunction and eviction order against the Defendant for the unsold portion, with costs to the Plaintiff.

Court Disposition

Plaintiff's suit allowed; Defendant's counter-claim dismissed.

Orders

  • An injunction restraining the Defendant from interfering with the Plaintiff's use and enjoyment of Machakos/Kiandani/243, except for the portion measuring 100feet by 260feet bought in 1977.
  • An order of eviction of the Defendant from the suit property, save for the portion bought in 1977.
