Ratio Decidendi

The court found that at the time the suit was filed in the Magistrates Court on 9th May 2012, jurisdiction over land matters was exclusively vested in the Environment and Land Court by statute. Practice directions issued by the Chief Justice could not confer jurisdiction on the Magistrates Court where none existed by law. As such, the proceedings, judgment, and orders of the Magistrates Court were null and void ab initio for want of jurisdiction. Consequently, the appeal was merited, the lower court's orders were set aside, and the suit was struck out for want of jurisdiction.
