Procedural Posture

Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time

  1. 1 Whether the applicant has demonstrated good and sufficient cause for failing to file the appeal within the prescribed time.
  2. 2 Whether the delay in filing the application for leave to appeal out of time is adequately explained.

Ratio Decidendi

The court found that the applicant failed to provide a credible or sufficient explanation for the delay in both applying for the proceedings and in filing the application for leave to appeal out of time. The period of delay was significant and not properly accounted for, and the discretion to extend time under section 79G of the Civil Procedure Act can only be exercised where good and sufficient cause is shown. As the applicant did not meet this threshold, the application was dismissed with costs to the 1st and 2nd respondents.

Court Disposition

application dismissed with costs to the 1st and 2nd respondents

Orders

  • The application for leave to file appeal out of time is dismissed.
  • Costs awarded to the 1st and 2nd respondents.
