Ratio Decidendi

The court found that the Appellant failed to demonstrate any substantial loss she would suffer if the stay order was not granted, as both parties admitted that neither had used the suit land since 2015/2016 and the Appellant's home was on a different plot. The court further noted that the Appellant's affidavit contained falsehoods regarding her residence on the disputed land, amounting to perjury. Consequently, the Appellant did not satisfy the requirements for grant of stay of execution under Order 42 Rule 6 of the Civil Procedure Rules. The application was therefore dismissed with costs to the 1st Respondent.
