  1. 1 Whether the applicant and her children are entitled to their share of the deceased's estate as previously decreed by the court.
  2. 2 Whether the respondent's denial of access to the applicant and her children to their portion of the estate is lawful.
  3. 3 Whether the court should grant orders to facilitate subdivision and access to the estate in accordance with the confirmed grant.

Ratio Decidendi

The court found that the applicant and her children are entitled to their share of the deceased's estate as previously determined by the court and agreed upon by the parties. The respondent's continued denial of access to the applicant and her children is without lawful justification. The court held that, in the interests of justice and in accordance with the confirmed grant and judgment, the suit property should be subdivided as decreed, and all parties should be enabled to take their respective shares. The application was therefore allowed as prayed, with orders facilitating subdivision, dispensation of title production, cost sharing, and police protection during the subdivision process.
