The property was still registered in the name of the deceased, and the Plaintiff was only later registered as trustee for all beneficiaries. Section 45 of the Law of Succession Act expressly prohibits any person from disposing of or intermeddling with the free property of a deceased person except as authorized by law or a grant of representation.
