The court found that the Plaintiff had proved his case as the registered proprietor of the suit property by producing an unchallenged certificate of title. The Defendants failed to file a defence or provide evidence to rebut the Plaintiff's claim or substantiate allegations of fraud. The Plaintiff was denied possession of his land since 2004 due to the Defendants' unlawful occupation, which constituted trespass. The court held that the Plaintiff was entitled to a declaration of ownership, eviction orders, and mesne profits as damages for trespass, assessed at Kshs 500,000 per year from 2004 until vacant possession is surrendered. Costs and interest were also awarded to the Plaintiff.
