Ratio Decidendi

The court found that the parties had entered into a valid consent, supported by their respective counsel, to empower the District Land Registrar, Chuka, to dispense with the necessity of producing the original title deed for L.R No. Mwimbi/Chogoria/501 in order to effect the transfer as per the judgment delivered on 31 July 2014. The court held that, in the interests of justice and given the applicant's age and health, as well as the inability to trace the original title deed, it was appropriate to adopt the consent as an order of the court. The application was therefore allowed, and the consent terms were made an order of the court, with no order as to costs.
