In re Estate of Ayaga (Deceased) (Succession Cause E005 of 2026) [2026] KEHC 8958 (KLR) (3 June 2026) (Ruling) Neutral citation: [2026] KEHC 8958 (KLR) Republic of Kenya In the High Court at Kisii Succession Cause E005 of 2026 Sifuna Nixon, J June 3, 2026 IN THE MATTER OF THE ESTATE OF THE LATE NASHON KING’OINA AYAGA Ruling 1.The Applicant Thames Nyanchoka King’oina through her Application dated 4th March 2026, applied for a Limited Grant of Letters of Administration Ad Litem, to the Estate of Nashon King’oina Ayaga (Deceased). 2.The deceased was a Kenyan National. who died intestate in a road traffic accident that occurred on 1st October 2024 in the Republic of Uganda. 3.From the grounds and the Supporting Affidavit, the accident occurred while the deceased was a passenger in a truck that as involved in an accident. His remains were repatriated to Kenya and buried in Kisii. The death occurred in October 2024. 4.From the Area Chief’s letter dated 14th October 2024, the deceased was the Petitioner’s husband. The letter also listed the deceased’s children. A Certificate of Death Abroad was issued. The same which is Serial No. 0101686, is dated 11th October 2024. 5.By this Application, the Applicant is seeking this Limited Grant, for purposes of filing a suit for damages. 6.Upon considering the Application, the Supporting Affidavit, as well as the supportive documents annexed to it, the Application is hereby allowed. In terms that a Limited Grant of Letters of Administration Ad Litem to the Estate of Nashon King’oina Ayaga (Deceased), shall issue to the Applicant Thames Nyanchoka King’oina, for purposes of filing a suit for compensation for the death of the deceased. 7.The Application for a full Grant be lodged within 60 days.
