Ratio Decidendi

The Court of Appeal held that the Law of Succession Act, Cap 160, is the governing law for the administration of estates of deceased persons, including advocates. The Act covers both personal and trust property, such as client accounts, and does not exclude law firms of deceased advocates. Legal Notice No. 279 of 1995, promulgated after the deceased's death, cannot operate retrospectively in the absence of express provision or necessary implication. Furthermore, the Legal Notice is inconsistent with the Law of Succession Act to the extent that it purports to establish a parallel regime for the administration of law firms of deceased advocates, which is not contemplated by the parent Act....
