Legal Notice No. 279 of 1995, promulgated by the Law Society of Kenya, could not override or create a parallel regime to the Law of Succession Act in the absence of express statutory authority. The Court found that the Legal Notice was inconsistent with the Law of Succession Act to the extent that it purported to vest control of a deceased advocate's accounts in LSK nominees rather than the estate's administrators.
