Ratio Decidendi

The court found that while the 2nd Defendant raised valid concerns regarding the doctrines of lis pendens and natural justice, the application to set aside the proceedings and the order marking the suit as settled was brought with unexplained delay and did not demonstrate sufficient cause. The court held that the ruling dismissing the suit for want of prosecution was delivered in the presence of most parties and was not ex parte. The Plaintiff had already obtained the relief sought through the revocation of the title deeds by the National Land Commission, and the matter was overtaken by events. The application was thus without merit, and the Plaintiff was entitled to costs.
