Ratio Decidendi

The court found that the stay order was made ex parte and is therefore provisional. The applicant was not a party to the Nairobi case and was unaware of it, so it would be unjust to hold that against him. The application for judicial review was not shown to be an abuse of process in the circumstances. The court exercised its discretion to set aside the stay order made on 18th August 2015, as the facts did not justify its continuation. However, all other orders made on 19th August 2015 were to remain in force.
