The court held that Order 23 rule 3(2) of the Civil Procedure Rules, which provides for abatement of suits where no substitution is made within one year of a plaintiff's death, does not apply to judicial review proceedings. The Civil Procedure Rules are not applicable to such proceedings, which are governed by Order 53. There is no provision under Order 53 for abatement due to death after 12 months. Furthermore, an application for substitution had already been filed and was pending at the time the application to strike out was made, rendering the latter application premature.
