The court found that, on the material before it, there was a real possibility that if the suit before the lower court was permitted to proceed to conclusion, the appellant's appeal would be rendered nugatory. The court also held that the absence of the formal order appealed against, due to the lower court's refusal to supply documents, was a technicality that should not defeat the application for stay. The court therefore exercised its discretion to grant a stay of proceedings pending the determination of the appeal, to preserve the subject matter and ensure that the appeal is not rendered academic.
