  1. 1 Whether the plaintiff/applicant has met the threshold for grant of a temporary injunction.
  2. 2 Who should bear the costs of the application.

Ratio Decidendi

The court found that the plaintiff, as one of the administrators of the estate, failed to demonstrate that the suit property was part of the deceased's estate, as it was not listed among the estate assets. The plaintiff did not establish a prima facie case or show that she would suffer irreparable harm that could not be compensated by damages. The defendants, on the other hand, were in possession of the property and had developed it, with evidence of an almost complete building. The balance of convenience therefore favoured the defendants. Consequently, the application for a temporary injunction lacked merit and was dismissed.
