The court found that the estate of the deceased comprised two parcels: Kirimukuyu/Kiria/463 and 2 acres out of Kirimukuyu/Kiria/459, as 2 acres of 459 had already been distributed in a prior confirmed grant and were not available for distribution in this cause. Applying section 40 of the Law of Succession Act, the court determined that the estate should be divided among the two houses of the deceased, with each house constituting a unit for the wife and additional units for each child. The house of Susan Wangechi (5 units) and the house of Catherine Mugure (3 units) thus resulted in a total of 8 units. The house of Catherine was entitled to 3/8 of the net estate and Susan’s house to 5/8....
