The court found that the suit property was surrendered for public use and held by the Commissioner of Lands in trust for the residents of Thindigua, most of whom were members of the 1st Defendant. The Plaintiff's acquisition of the property for private commercial use was unlawful and in breach of the public trust doctrine. The Plaintiff's title was therefore null and void, and it could not convey any valid interest to the 4th Defendant, who acquired the property while litigation was pending and was bound by the doctrine of lis pendens. The 1st Defendant, as a beneficiary of the trust, was not a trespasser, and its adverse possession claim was inconsistent with the nature of public trust...
