The appellant, having filed and prosecuted an application for review of the judgment, was precluded by law from subsequently lodging an appeal against the same judgment. The court found that the preliminary objection raised by the 3rd party was meritorious, as the appellant's attempt to appeal after review amounted to an abuse of process and contravened the principle of finality in litigation.
