The trial court erred by failing to consider the applicant's period in remand when determining the commencement date of the sentence, as required by Section 333(2) of the Criminal Procedure Code. Despite the applicant's prior absconding and the resulting denial of bail, the law mandates that any period spent in custody prior to sentencing must be credited towards the sentence. The High Court, exercising its revisionary jurisdiction, found the commencement date of the sentence to be irregular and ordered that the sentence be deemed to have commenced on the date of arrest (4/04/2018).
