Procedural Posture

Land Dispute / Judgment

  1. 1 Whether parcel number KOITOROR/TUIYOLUK BLOCK 1 (KOITOROR)174 belongs to the Plaintiff and ought to be registered as such.
  2. 2 Whether orders of permanent injunction and eviction ought to be issued against the 2nd Defendant from claiming or using part of parcel number KOITOROR/TUIYOLUK BLOCK 1 (KOITOROR)174.

Ratio Decidendi

The plaintiff's evidence, supported by documentary exhibits and corroborated by a witness, established that the suit parcel was intended for the plaintiff and that the 2nd defendant encroached on his land by taking more than his allocated share. The defendants failed to contest the claim or provide any rebuttal. The court found that the plaintiff had proved his case on a balance of probabilities. Applying Section 80 of the Land Registration Act, 2012, and relevant case law, the court held that it had the power to order rectification of the register and title to reflect the true ownership and to grant injunctive and eviction orders to protect the plaintiff's rights.

Court Disposition

Judgment for the plaintiff against the defendants jointly and severally.
