The evidence presented by the 5th defendant consisted only of his affidavit and a letter of inquiry, which were insufficient in light of the categorical affidavits by Momanyi and the 1st defendant, both asserting that the 5th defendant had instructed the firm and participated in the proceedings. The 5th defendant did not deny attending court or consulting with Momanyi, nor did he provide a convincing explanation for the delay in raising the issue.
