Ratio Decidendi

The court found that the 9th Counterclaim Defendant, Safaricom Investments Co-operative Society Ltd, was joined to the proceedings without the requisite leave of the court as required by Order 1 Rule 10(2) of the Civil Procedure Rules. The application to amend the defence and introduce a counterclaim did not mention the Applicant's land or seek its joinder. Since the Applicant was not a party to the original claim and there was no formal application or leave granted for its joinder, its inclusion as a defendant in the counterclaim was unlawful. Consequently, the counterclaim against the Applicant disclosed no reasonable cause of action and was struck out. Costs were awarded to the Applicant.
