Ratio Decidendi

The court held that the Mathira Land Disputes Tribunal, established under Section 3(1) of the Land Disputes Tribunals Act (now repealed), had no jurisdiction to hear and determine disputes relating to title and ownership of registered land. Since the dispute before the Tribunal concerned title to LR Konyu/Ichuga/699, the Tribunal's proceedings and award were a nullity in law. The appeal was allowed solely on the ground of lack of jurisdiction, and the parties were restored to the status quo ante the Tribunal proceedings.
