The court found that the plaintiff was aware of the ex-parte orders as early as November 2011, as evidenced by a letter addressed to the Chief Justice. The explanation for the delay in filing the review application was therefore not plausible. The court held that the application for review was filed after an unreasonable delay, contrary to the requirements of Section 80 of the Civil Procedure Act and Order 45 of the Civil Procedure Rules. Consequently, the plaintiff failed to meet the threshold for review, and the motion was dismissed with costs abiding the outcome of the suit.
