Ratio Decidendi

The court found that there was no valid decree or order issued by the court directing the plaintiffs to deliver possession of the suit land to the defendants. The previous eviction was based on a warrant that was erroneously issued in the absence of such an order. Since the defendants never filed a counterclaim or sought an order for vacant possession in the original proceedings, and the only relief granted was the striking out of the plaintiffs' suit, there is no legal basis for granting the eviction order now sought. The application for eviction is therefore without merit and must be dismissed.
