Ratio Decidendi

The court determined that the dominant issue in the appeal was the legality of statutory notices and the exercise of the statutory power of sale, which constitutes a commercial dispute rather than a dispute over the use, occupation, or title to land. Guided by the Court of Appeal's decision in Co-operative Bank of Kenya Limited v Patrick Kangethe Njuguna & 5 others, the court held that such matters fall outside the jurisdiction of the Environment and Land Court. As jurisdiction is fundamental and cannot be assumed or conferred by the parties, the court was compelled to strike out the appeal for want of jurisdiction, without considering the merits of the substantive grounds raised.
