Ratio Decidendi

The court found that the Respondent failed to establish a valid reason for the Claimant's termination as required under Section 43 of the Employment Act and did not comply with the mandatory procedural fairness requirements of Section 41. The evidence did not show that the Claimant was properly notified or given a chance to participate in disciplinary proceedings. As a result, the termination was both substantively and procedurally unfair. The court awarded the Claimant three months’ salary as compensation, considering his length of service and the Respondent’s conduct.
