Procedural Posture

Succession Cause / Ruling on Summons to Cancel and Reverse Registration of Land

  1. 1 Whether the succession court has jurisdiction to cancel and reverse registration of land allegedly obtained fraudulently after confirmation of grant.
  2. 2 Whether the applicant is entitled to be registered as proprietor of the disputed land parcel based on the certificate of confirmation of grant.

Ratio Decidendi

The court held that it lacked jurisdiction to entertain the applicant’s request to cancel and reverse the registration of the disputed land parcel, as the succession court’s role ended with the confirmation and distribution of the deceased’s estate. Any issues arising from alleged fraudulent registration or deprivation of the applicant’s interest in the land must be addressed before the Environment and Land Court, which has the mandate to determine questions concerning title to, occupation, and use of land. The succession court, having already issued a valid certificate of confirmation of grant, is functus officio and cannot grant further orders regarding the property in question.
